Willful child neglect is a criminal offense, primarily governed in England and Wales by Section 1 of the Children and Young Persons Act 1933 (as amended).

It occurs when a person over 16 with responsibility for a child intentionally or recklessly fails to provide adequate food, clothing, shelter, or medical care, or fails to protect them from harm, causing or likely to cause unnecessary suffering or injury to health.

As a minimum reasonable care standard (especially for doctors trained in pediatric emergencies, first aid, and child safeguarding), yes—a visual check would be expected for hazards like choking (common in toddlers 1–3 years old), breathing issues, or sudden illness. Listening alone doesn’t detect silent choking, cyanosis, or other non-noisy emergencies 5 there were doctors
